Pop music group No Doubt is suing Activision over the fact that the band's likenesses can be used for other songs.
Pop music group No Doubt has announced that it is suing Activision for a break of contract in recent rhythm game,
Band Hero. The group is claiming that it never agreed for avatars in it's likeness to perform songs by other bands.
The legal dispute is the same as the one bought to Activision by Courtney Love over Kurt Cobain's avatar in
Guitar Hero 5, that it was never agreed that the likeness could be used to perform songs by other groups.
"
Without the band's knowledge or approval, Activision turned the group into virtual karaoke players by having them perform over 60 additional songs by other musical groups," said the band's lawyers in a statement, according to
Gamasutra.
No Doubt says it has already requested that Activision change the use of their avatars in the game, but that Activision has refused to do so on the grounds that it would be too expensive to bother.
"
Activision has a written agreement to use No Doubt in Band Hero - an agreement signed by No Doubt after extensive negotiations with its representatives," goes the official Activision statement.
"
As a result, Activision believes it is within its legal rights with respect to the use and portrayal of the band members in the game and that this lawsuit is without merit."

I don't see Clive Winston complaining that he's only allowed to play songs by the Donnas. Funnily enough, I don't remember Bret Michaels complaining about GH3 either! Get a wad of cash, get in a video game, see record sales boosted as a result!

In all reality though, why are they so mad? Their avatars get more exposure, unless this is an issue of compensation. I.E they thought they should get paid since their toons are being used more.
I am fairly sure they would prefer to stay in and get paid than get kicked out and never be in another music game by Activision.
There's no doubt that suing someone is the easiest way to make money for such crap bands like this.
I get the impression they're taking it quite seriously. They're douchebags for not realising they'd be playing other songs, but I can appreciate why it may have been a bit of a shock to see their likenessess running around singing Hanson.
If you uploaded your photo to Bit-Tech because they wanted to use it on a fan-collage, and you logged on one day to discover it being used to cover up the genitals on a nude picture of Harry, you might be a bit miffed as well.
Hope they get sued to death.
Serves them right for not spelling it out correctly to the bands involved and getting a cast iron contract to start with.
Also, anyone who thinks Nirvana/Kurt Cobain and No Doubt are nobodies really doesn't have a very broad interest in music as both were huge in their own right for a not inconsiderable length of time.

I think we'd all be miffed that said genitals are covered up, but you just have to deal with it and move on with your life.
