Brazilian sex video scandal could cost YouTube

Former fiancée of world renowned, buck-toothed footballer Ronaldo, Danielle Cicarelli, is suing Youtube after the site played host to a naughty video starring her. In the video she is seen in coitus with her boyfriend Tato Malzoni, whilst bathing in the sea.

The really interesting thing about the case is the amount of money the model is suing YouTube for. For every single day that the video has been uploaded the model is demanding $116,000 compensation - that's the equivalent of £60,000.

A Brazilian court has now ruled that YouTube be shut down until the video has stopped being uploaded. Unfortunately, due to the user-driven nature of the site, YouTube has failed to stop the video from being circulated. Every time the company has attempted to delete it, the video has been resubmitted again and again. For a time, it was the most viewed video in Brazil.

It's highly unlikely that the Brazilian court will be able to have YouTube shut down though. With the company based in the United States it's unclear what right a Brazilian court has. What's more likely is for Brazil to pursue an avenue where they block all YouTube related content from the country. That, however, probably wouldn't go down too well with the locals.

The suing, which will no doubt increase the model's worldwide profile, hasn't stopped the spread of the video. Metro News is now currently hosting the official video, whilst YouTube - as is expected - is playing host to plenty of spoofs. Our favourite is the mosquito parody below (to appreciate it fully you need to see the original).

Do you think Cicarelli has a case? Should Brazil be able to shut down YouTube? Let us know your thoughts in the forums.

It was going to happen one day, but I reckon in the T&C somewhere it'll say that YouTube do not have direct control over content, this kinda shows what I meant when I posted about Rich's column

AHA, well perhaps famous Brazillian models should not have sex in public places ;)

I can see this lawsuit extending well beyond YouTube, since the Metro video is hosted on Break.com

I don't think it'd stand much a chance to be fair. If she's willing fondle his meat saussage on a beach and then cure that itch between her legs in the sea then she does so knowing that someone IS going to see, It's hardly YouTube's fault she was hot in the pants =P

I presume everyone has now seen the video? Huge disappointment.

She's clearly filing spurious law suits to try to make her video notorious to raise her own profile. "Oooops - I'm a famous model and I was cavorting with my boyfriend in the sea in plain view of everyone. How was I supposed to know there would be paparazzi in the bushes? How dare they take video footage on a completely public beach?"

Video is not even that good. Compared to Pamela Anderson and Paris Hilton. I think she is well out of order. Her fault anyway, she cant blame anybody. I dont see the point, *if* i was her, i wouldnt care less, so what, you cant see anything.

in fact she was the one that committed a crime, by law you can not have sex in public places....... especially in a public beach were anyone can see you, even children.

Which law is that? I don't know where the video was made, but assuming it's Brazil, I have no idea what the indecency laws are there.

Just saw the video, after a quick google search.
My favorite part is when the guy obviously tries to hide his massive boner by hanging a bunch of see weed over it, cus that's the exact thing I'd do to avoid atention.

It's working to get attention. I had no idea who the hell this chick was until her sex vid. was mentioned here.

Didn't Paris Hilton start off as a sex video? She definetly wasn't as big as today until the world had to watch her blow off in a beautiful tint of green.
